General information

We take the protection of your personal data very seriously and treat it confidentially and in accordance with statutory data protection regulations and this privacy policy. This privacy policy applies to our mobile Android apps (hereinafter "apps"). It explains the type, purpose, and scope of data collection when using the apps. We point out that data transmission over the Internet can be subject to security gaps. Complete protection of data from access by third parties is not possible.

The terms used are not gender-specific.

General Privacy Policy

In addition to this privacy policy specific to the app, the privacy policy of the TrainingLab/HRMProfil project page describes further processes that affect both the website and the app.

General storage period for personal data

Unless otherwise stated or specified in this privacy policy, this app does not store any personal data.

Legal basis for the storage of personal data

The processing of personal data is only permitted if there is an effective legal basis for processing this data. If we process your data, this is generally done on the basis of your consent in accordance with Art. 6 (1) (a) GDPR (e.g., if you voluntarily provide your data in the registration form or as part of the contact form), for the purpose of fulfilling the contract in accordance with Art. 6 (1) (b) GDPR, or based on legitimate interests in accordance with Art. 6 (1) (f) GDPR, which are always balanced against your interests (e.g., in the context of advertising measures). The relevant legal bases will be specified separately in this privacy policy if necessary.

Your rights

The General Data Protection Regulation (GDPR) grants data subjects whose personal data is processed by us certain rights, which we would like to inform you about here.

Revocation of your consent to data processing

Many data processing operations are only possible with your consent. We will expressly obtain this from you before starting data processing. You can revoke this consent at any time. An informal email to us is sufficient for this purpose. The legality of the data processing operations carried out up to the revocation remains unaffected by the revocation. RIGHT OF OBJECTION TO DATA COLLECTION IN SPECIAL CASES AND TO DIRECT MARKETING (ART. 21 GDPR) IF DATA PROCESSING IS CARRIED OUT ON THE BASIS OF ARTICLE 6 (1) LIT. E OR F GDPR, YOU HAVE THE RIGHT TO OBJECT TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU AT ANY TIME FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. The respective legal basis on which processing is based can be found in this privacy policy. If you object, we will no longer process the personal data concerned unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or that serve the purpose of asserting, exercising, or defending legal claims. If your personal data is processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such marketing purposes; this also applies to profiling insofar as it is associated with such direct marketing. If you object, your personal data will subsequently no longer be used for direct marketing purposes.

Right to lodge a complaint with a supervisory authority

In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority. This right of complaint is without prejudice to other administrative or judicial remedies

Information, deletion and correction

You have the right at any time to obtain free information about your stored personal data, its origin and recipient, and the purpose of data processing, as well as the right to have this data corrected or deleted. You can contact us at any time at the address provided in the legal notice for this purpose and for other questions regarding personal data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You can contact us at any time using the address provided in the imprint. The right to restriction of processing exists in the following cases: If you dispute the accuracy of the personal data stored by us, we generally need time to verify this. For the duration of the verification, you have the right to request the restriction of the processing of your personal data. If the processing of your personal data was/is unlawful, you can request the restriction of data processing instead of deletion. If we no longer need your personal data, but you need it to exercise, defend or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion. If you have lodged an objection pursuant to Art. 21 (1) GDPR, a balance must be struck between your interests and ours. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data. If you have restricted the processing of your personal data, this data may – with the exception of its storage – only be processed with your consent or for the establishment, exercise or defense of legal claims or to protect the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.

Right to data portability

You have the right to have data that we process automatically based on your consent or in fulfillment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done if technically feasible.

App access rights

To provide our services via the apps, we need the access rights listed below, which allow us to access certain functions of your device.

    WRPElevationChart:

    Note:
This app uses various online map services (Web Map Tile Services (WMTS)).
Since the map view is a central function of the GPS viewer functionality, it must establish a connection with these external services.
Web Map Tile Services are geoservices that offer digital maps on a tile basis. These services provide small map sections (tiles) on the server side, which can be downloaded from the internet. The downloaded tiles are put together by the app to create a complete map.
The app uses the osmdroid library for this. The maps are retrieved from external servers. In the process, your location data (IP address, etc.) may be passed on. This app has no influence on this data transfer*, which is usually anonymous!

    * As far as I know, this data is used solely for the purpose of displaying the map functions and temporarily storing the selected settings. This data can include, in particular, IP addresses and location data of the users.

Furthermore, this app allows manual uploading of imported GPS activities to various web services. These downloads must be performed manually using the so-called web export function. Regarding any data protection regulations of the respective web services, you must inform yourself there, as this is not under the control of this app: WRPElevationChart does not upload any data to external web services without your consent, so you are the sole controller!

By using this app, you explicitly agree to the inclusion of external services!

Write and read permissions [WRITE_EXTERNAL_STORAGE, READ_EXTERNAL_STORAGE]:
  • a) for optionally saving the elevation profile data
  • b) required to create an optional screenshot graphic if you want to use the share function, which does nothing other than transfer a screenshot graphic file to another app
  • c) for caching the map tiles (OSMDroid)
  • d) for the smooth functioning of the browser mode as far as possible (in browser mode, the app must be able to access entire directories - including the external storage - otherwise this browser mode makes no sense)
  • e) for the easy integration of optional Mapsforge maps (*.map files).

  • Network rights [INTERNET, ACCESS_NETWORK_STATE]:
  • Tiles required to download the maps

NOTE: When using the map view, data (map sections, so-called tiles) is DOWNLOADED from the internet. This may result in additional charges when using a mobile data connection. A Wi-Fi connection or a mobile data plan is therefore strongly recommended!

  • Location data [ACCESS_COARSE_LOCATION, ACCESS_FINE_LOCATION]:
  • These are only needed if you want to use the 'JumpTo' home function in the map view, which simply centers the map on the last known location! This app does not (currently) have GPS logging features!

  • WRPSpeedToolbox:

Starting with version 1.0.20, Android > 5.0 is required; therefore, the app does not require any special permissions.

    Write permissions [WRITE_EXTERNAL_STORAGE]:
  • On Android versions below 4.4, the app requires access to the device's external storage when using the 'Share' function (Android Permission: [WRITE_EXTERNAL_STORAGE]). This access is necessary so that the app can, if necessary, take a screenshot of the current screen and save it as a PNG file to share this graphic file with an external app of your choice. The sharing function must be explicitly accessed via the corresponding menu item in the app; it does not run hidden in the background.

  • WRPBitMaskHelper:

No special permissions are required to run this app.

This app does not require any further permissions. Access to the device functions is necessary to ensure the functionality of the app. The legal basis for this data processing is our legitimate interest within the meaning of Art. 6 (1) (f) GDPR, your consent within the meaning of Art. 6 (1) (a) GDPR, or – if a contract has been concluded – the fulfillment of our contractual obligations (Art. 6 (1) (b) GDPR). These permissions remain in effect until the app is uninstalled from your device.

Collection of personal data when using the app

In general, when you use our app, we may collect the following personal data from you (the actual amount depends on the extent of use; e.g., use as a logged-in user versus use as a guest): Master data (e.g., user name, email address, other contact details if provided) Anonymized usage data IP address when connected Device identifier (e.g., for push notification registration) Metadata The processing of this personal data is necessary to ensure the functionality of the app. The legal basis for this data processing is our legitimate interest within the meaning of Art. 6 (1) (f) GDPR, your consent within the meaning of Art. 6 (1) (a) GDPR or - if a contract has been concluded - the fulfillment of our contractual obligations (Art. 6 (1) (b) GDPR).

Request within the APP, by email, telephone or fax

If you contact us (e.g. via the contact form within the app, by email or telephone), your inquiry, including all personal data resulting from it (e.g. name, inquiry), will be stored and processed by us for the purpose of processing your request. This data is processed on the basis of Art. 6 (1) (b) GDPR if your inquiry is related to the fulfillment of a contract or is necessary to carry out pre-contractual measures. In all other cases, the processing is based on your consent (Art. 6 (1) (a) GDPR) and/or on our legitimate interests (Art. 6 (1) (f) GDPR), as we have a legitimate interest in the effective processing of the inquiries addressed to us. The data you send to us via contact request will remain with us until you request us to delete it, revoke your consent to storage or the purpose for storing the data no longer applies (e.g. after your request has been processed). Mandatory statutory provisions - in particular statutory retention periods - remain unaffected. We will not pass on your data to third parties without your consent.

Comment function in this app

For the comment function in this app, in addition to your comment, information about the time the comment was created and, if you do not post anonymously, the username you chose will be saved. Comments are saved based on your consent (Art. 6 (1) (a) GDPR). The comments and the associated data will be saved and remain in the comments section and on our servers until the commented content has been completely deleted.

Data analysis

When you access our app, your behavior may be statistically evaluated using certain analysis tools from the Google Play Store and analyzed for advertising and market research purposes or to improve our offerings. When using such tools, we ensure compliance with statutory data protection regulations to the extent that we have control over them. When using external service providers (contract processors), we ensure, through appropriate contracts with the service providers, that data processing complies with German and European data protection standards. You can disable the use of these tools, which are intended for anonymous data analysis, in the app settings and thus object to their use. Disabling these tools will suppress the execution of the respective tools.
